These Terms of Service ("Terms") govern your access to and use of the Horary mobile application and related services (collectively, the "Service"). By downloading, installing, accessing, or using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

To access certain features, you may need to create an account (including using third-party sign-in such as Google or Apple). You are responsible for maintaining the confidentiality of your account and for all activity under your account.
You agree to provide accurate information and to keep your information up to date.
Some parts of the Service may require a paid subscription ("Subscription"). If you purchase a Subscription through Apple's App Store:
If you purchased a Subscription through a different platform, your subscription is managed by that platform's billing terms.
Our collection and use of personal data is described in our Privacy Policy. You can delete your account in the app (Settings > Account > Delete Account) or by contacting us. Some information may be retained as required or permitted by law (for example, for fraud prevention or compliance).

The Service, including its design, text, graphics, interfaces, and other content, is owned by Horary or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
The Service may rely on third-party services (for example, Firebase, RevenueCat, and Google Maps). Your use of third-party services may be subject to their own terms and policies. We are not responsible for third-party services.
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if we must do so to protect the Service, users, or the public. You may stop using the Service at any time and may delete your account through the app.
To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. We disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Horary will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
To the extent liability cannot be excluded, Horary's total liability for all claims relating to the Service will not exceed the amount you paid to Horary for the Service in the twelve (12) months before the event giving rise to the claim (or, if you have not paid anything, 0 TRY), unless applicable law requires a greater amount.
You agree to indemnify and hold harmless Horary from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles.
Unless mandatory consumer protection laws provide otherwise, you agree that the courts of Istanbul, Turkey will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of the remaining provisions.
If you downloaded the Service from the Apple App Store, you acknowledge that Apple is not a party to these Terms, is not responsible for the Service, and has no obligation to provide maintenance or support. Apple may be a third-party beneficiary of these Terms and may enforce them against you.
